    It is important that you read these general terms and conditions of sale (“Terms of Sale”) carefully before proceeding to order products through our website. These Terms and Conditions of Sale govern the contractual relationship with respect to the website and the purchase of products made through it.     PURPOSE OF THE CONTRACT

    An “on line” sale contract is intended as a distance contract, that is, a legal transaction having as its object movable goods and/or services stipulated between a supplier, in this case the website  ledial.it of the company Ledial srl (hereinafter, “Ledial”) with registered office in via Padova 156 20132 (MI, Italy), enrolled in the Register of Enterprises of the C. C.I.A.A. of Milan with P.I. 0277012133 and a consumer customer within a system of distance selling organized by the supplier who, for this contract, uses only the technology of distance communication called “internet”.

    SITE REGISTRATION

    In order to purchase products present in the electronic catalogue of ledial.it it is mandatory to register on the website providing information to receive notifications from Ledial and the postal address for the purpose of receiving the order.

    It is strictly forbidden for the customer to provide false, invented or made up data during the registration procedure. Personal data and email must be real and personal and not third parties. Creating double accounts related to one person or providing third parties data is forbidden.

    Ledial reserves the right to legally pursue any violation and abuse in the interest and for the protection of all consumers.

    PURCHASING PROCEDURE AND CONCLUSION OF CONTRACT

    The costumer, after viewing the items with related prices and delivery costs and estimated delivery time, proceeds by expressing the will to purchase one or more items.

    The contract stipulated between Ledial and the Customer must be considered concluded with the acceptance of the order with an email by Ledial. An order placed by anyone under the age of 18 and/or who is not in possession of a tax code and/or VAT number is considered to have no effect.

    With regard to the purchased of used valuables the customer must send a valid identity document during the purchase procedure, as required by law. In the absence of this document the sale could not be processed.

    SELLING PRICES

    All prices of product displayed in the on line catalogue are expressed in euros and include VAT. The customer can pay for the goods ordered with the payment methods indicated on the website at the time of purchase. The prices displayed on Ledial.it are valid only for orders placed online, for which there is however the possibility to collect the item directly in the store.

    Ledial constantly checks that all the prices indicated on the site are correct, without this, however, guaranteeing the absence of errors. If an error is found relating to the price of a product, Ledial will give the customer the opportunity to reconfirm the order for the product at the correct price or to cancel it.

    STORAGE AVAILABILITY

    If the purchased item is not available in stock, Ledial will communicate the times of availability and send it as soon as possible. If it is no longer available, and a valid replacement could not be found, Ledial will refund the price.

    PRODUCT DESCRIPTIONS AND IMAGES

    All product descriptions published on the ledial.it website are, as far as possible, up-to-date and accurate. However, they may differ insignificantly from the purchased product, for example in color, shape and size. For a better display of the products offered some images are enlarged with respect to the original and therefore not in 1:1 scale.

    Gemstones are commonly treated to enhance color or clarity. The colors on screen may appear different from reality. Some characteristics of the gems or of the jewels in sale, such as carat, shape and color, are to be considered indicative and may undergo slight increases or decreases compared to what is indicated in the respective analytical data sheets of the products so as not to bring significant changes to overall value nor to the appearance of the jewel.

    PACKAGING

    All purchased products are sent in a gift box without any additional cost. The packages may vary in shape and color compared to those published on the site, which are therefore to be considered purely indicative.

    METHODS OF PAYMENT

    Payment can be made, at your choice, by:

    1. Credit card. Using the PayPal service (please refer to the Paypal terms of use). Once you have chosen this method, you will be transferred directly to the dedicated PayPal website and you will be able to make your payment in complete security.
    2. Bank transfer. Once you have chosen this method, you will receive an e-mail confirming the purchase order in which you will be given the bank details to proceed with payment. As indicated in that e-mail, sending the CRO (transaction reference code, consisting of 11 digits that uniquely identify the transaction) of the bank transfer to info@ledial.it will speed up the shipment of the goods you have purchased to the address you have indicated.

    DELIVERY METHODS, SHIPMENTS AND TIMING

    The customer can choose whether to receive the item at his or her address or another address indicated or to collect it from one of the Ledial sales points.

    Ledial ships with selected couriers throughout Italy at a cost of 15.00 euros. All goods travel with insurance. For the remaining countries, additional costs may be charged to the purchaser, which will be calculated from time to time, according to the various factors that contribute to establish the cost of a shipment. In case of absence of the addressee at the time of delivery, a notice will be left and the customer must personally contact the courier or forwarding agent as soon as possible to agree on the delivery method. The shipping address is the one indicated by the customer during the online purchase, unless otherwise agreed in writing between the parties.

    If you notice any anomalies in the package (probably due to tampering) you must sign with “reserve control”. Otherwise we will not be able to reimburse you for any breakage or damage to the purchased product. Under no circumstances will shipments be made to post office boxes, mail boxes and the like. The delivery of the purchased object will take place in about 3-5 working days from the date of payment. This indication is valid for deliveries in Italy, for all other destinations the timing will be calculated from time to time.

    In the case of collection at a point of sale, the customer will be notified by email, as soon as the object will be available for collection.

    RESPONSIBILITY

    Ledial doesn’t assume any responsibility for inefficiencies due to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that would prevent, in whole or in part, the execution of the contract within the agreed time. Ledial shall not be liable to any party for damages, losses and costs incurred as a result of the non-execution of the contract for the reasons mentioned above, the consumer having only the right to a restitution of the payment made.

    Likewise, Ledial cannot be held responsible for any fraudulent or illicit use that can be done by third parties of credit cards and other means of payment when paying for the products purchased.

    RIGHT OF WITHDRAWAL

    The consumer who for any reason is not satisfied with the purchase made, has the right to terminate the contract without penalty and without specifying the reason, within 10 working days from the date of receipt of goods. The withdrawal must be requested by sending – in the mentioned term of 10 days – a registered letter to Ledial srl via dei Valtorta 44 – 20127 Milan or an e-mail to info@ledial.it. The consumer cannot exercise this right for products made to measure or clearly personalized and if the following conditions do not exist: the products must not bear signs of wear, abrasions, scratches or scuffs such as to compromise the resale of the same; the products must be returned in their original packaging. Within the above-mentioned period of 10 days the goods shall be returned by insured shipment to the sender-supplier but only after authorization by Ledial. The costs of return shall be borne by the client except in the case where the goods do not conform to the order, in which case instructions will be given for the taking by a courier.

    Ledial shall provide for the forwarding of the entire amount paid by the consumer within 7 working days from the date of receipt of the goods shipped by the client, except for any costs of restoration for damages assessed to the goods. It will be cure of the consumer to timely supply the banking coordinates on which to obtain the transfer (Cod. ABI, CAB, Account of the holder of the invoice).

    CONFERMENT AND PROCESSING OF PERSONAL DATA

    Personal data are collected with the purpose of registering the customer and activate the procedures for the execution of this contract and the necessary communications; these data are processed electronically in compliance with applicable laws and can be produced only at the request of the judicial authority or other authorities authorized by law. Personal data will be communicated to subjects delegated to carry out the necessary activities for the execution of the contract and disseminated exclusively for that purpose.     Owner and responsible for the collection and processing of personal data is the company Ledial srl.

    JURISDICTION AND COMPETENT COURT

    Any controversy relative to the application, execution, interpretation and violation of the purchase contracts stipulated “on line” through the website ledial.it is subject to Italian jurisdiction; for any controversy between the parties regarding this contract the Court of Milan shall have jurisdiction.
